PRIVACY POLICY
§ 1

This Privacy Policy sets out the rules for the processing of personal data of users of the online store available at:https://www.robosavex.pl/(hereinafter referred to as the Online Store; Store), operated by GM AUTOMATYKA spółka z ograniczoną odpowiedzialnością with its registered office in Olkusz, ul. Sikorka 51, 32-300 Olkusz, entered into the Register of Entrepreneurs of the National Court Register under the number 0000641376, REGON: 365613777, NIP: 6492306557 (hereinafter referred to as the Seller). The Store Users are both Customers and other persons using the Store's website.

The controller of the Users' personal data is the Seller, i.e. GM Automatyka spółka z ograniczoną odpowiedzialnością with its registered office in with its registered office in Olkusz, ul. Sikorka 51, 32-300 Olkusz, entered into the Register of Entrepreneurs of the National Court Register under number 0000641376, REGON: 365613777, NIP: 6492306557. The Controller processes Users' personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the GDPR, and in accordance with the Personal Data Protection Act of 10 May 2018 (Journal of Laws of 2019, item 1781, consolidated text).

The Administrator collects Users' personal data provided by them in connection with creating an Account, using the Newsletter service, completing the Order Form, as well as as a result of contact by email, telephone, or post. In addition, the analytical tools used in the Store provide anonymous information about how Users use the Store.

Users who create an Account provide the Administrator with the following personal data:

in the case of an Entrepreneur, additionally: company name and Tax Identification Number.
3. Users using the Newsletter service provide the Administrator with the following personal data:

4. Users completing the Order Form or placing an Order by email or telephone provide the Administrator with the following personal data:

phone number,

individually created password,

address details,

in the case of an Entrepreneur, additionally: company name and Tax Identification Number.
5. Providing personal data is voluntary, however, refusal to provide it will prevent the conclusion and execution of contracts with the Seller.

By using the free Newsletter service, you consent to the sending of commercial information from the Seller as part of the Newsletter within the meaning of the Act on the Provision of Electronic Services (Journal of Laws 2020, item 344, consolidated text) and the Telecommunications Law (Journal of Laws 2019, item 2460, consolidated text). You may withdraw your consent at any time by unsubscribing from the Newsletter service. The revocation does not affect the lawfulness of previously undertaken actions.

The legal basis for processing Users' personal data is:
a) 6 sec. 1 point b) GDPR: Processing is necessary for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject before entering into a contract.
Purposes of processing based on the above basis:
- conducting negotiations and arrangements regarding the conclusion of a sales contract or a service contract, including receiving Orders, responding to contacts from potential Customers regarding inquiries about specific products/services;
style="font-weight:normal;">- sale of products through the Online Store (conclusion and performance of the sales agreement);
- implementation of the free electronic Newsletter service;
- implementation of the free Account service;
- implementation of the free Order Form service.
b) 6 sec. 1 point c) GDPR: Processing is necessary to comply with a legal obligation to which the controller is subject.
Purposes of processing based on this basis:
- compliance with legal obligations to which the Seller is subject, e.g. tax or accounting obligations.
c) Article 6 sec. 1 point f) GDPR: Processing is necessary for the purposes of the legitimate interests pursued by the controller.
d) telephone contact with Customers in matters related to the execution of orders, customer account management, and responses to inquiries addressed to the Seller.
Purposes of processing based on the above basis:
- direct marketing of the Seller's services and activities (providing the Newsletter service to subscribers, obtaining anonymized statistical data on the use of the Online Store website by Users);
- possible determination and pursuit of the Seller's claims or defense against claims.

Users' personal data is transferred to the Seller's contractors and other entities with whom the Seller cooperates in connection with the business activities conducted within the Online Store. Depending on the circumstances and the role of the external entity, it is either an independent controller of the transferred personal data (i.e., it has its own legal basis for processing them) or processes personal data on the Seller's instructions. Independent controllers include postal and courier companies, banks, external entities operating payment systems, and law firms. Entities processing personal data on the Seller's instructions include, among others, Accounting, tax, and IT firms, software providers, hosting providers, and email service providers.

The Administrator uses an external tool to handle Newsletter sending, which processes Users' personal data at the Administrator's request as a processor. This data includes, in particular, email addresses. The Administrator has concluded a personal data processing agreement with the tool provider.

The Seller notes that it transfers Customers' personal data to the courier company used to deliver the purchased Products. By choosing to have the Products delivered by courier, the Customer consents to the transfer of his/her relevant personal data to the above-mentioned entities. These entities, as independent personal data controllers, apply their own personal data processing and protection policies.

If requested, the Seller also provides personal data to authorized entities and authorities, such as the Police, the Prosecutor's Office, and the President of the Personal Data Protection Office.

Personal data is transferred only within the European Economic Area (EEA).

Personal data is stored for various periods of time:

Within the scope of fulfilling Orders, sales contracts, and contracts for the provision of services electronically: for the period of negotiation, conclusion, and fulfillment of these contracts, and then for the limitation period for any claims by the Seller or which may arise against the Seller. Unless a specific provision provides otherwise, the limitation period is six years, and for claims for periodic benefits and claims related to running a business – three years.

Within the scope of fulfilling the legal obligations incumbent on the Seller as a controller of personal data: for the period specified in the law for a given obligation or until such obligation is fulfilled.

Within the scope of fulfilling the Seller's legitimate interests: for the duration of such legitimate interests.
6. Personal data is not subject to automated decision-making, in particular profiling.

Users have the following rights regarding their personal data:
- access to this data,
- request rectification, erasure, or restriction of processing,
- object to processing,
- transferring data and sending it directly to another entity (controller).
2. The exercise of each of the above rights is possible by contacting the Seller.
3. To the extent that personal data are processed on the basis of Article 6 paragraph 1 letter b) of the GDPR, f) GDPR (e.g., direct marketing). The User may object at any time to further processing of their personal data for reasons relating to their particular situation. The Seller may then no longer process them unless it demonstrates compelling and legitimate grounds for further processing that override the User's interests, or there are grounds for establishing, pursuing, or defending legal claims. If the objection concerns the processing of personal data for direct marketing purposes, the Seller is obliged to cease further processing of the data for this purpose.

The User has the right to lodge a complaint with a supervisory authority, in particular in the European Union Member State of their habitual residence, place of work, or place of alleged infringement. In Poland, the supervisory authority is the President of the Office for Personal Data Protection. Personal (ul. Stawki 2, 00-193 Warsaw).

The User has the right to obtain from the Seller confirmation as to whether their personal data are being processed and, if so, access to them and the following information: the purposes of processing, the categories of personal data concerned, information on the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations, where possible, the planned period for which the personal data will be stored, and if this is not possible, the criteria for determining this period, information on the right to request from the controller rectification, erasure, or restriction of the processing of personal data concerning the data subject, and to object to such processing, information on the right to lodge a complaint with a supervisory authority; if the personal data were not collected from the data subject – all available information on their source, information on automated decision-making, including profiling. The Controller shall provide the data subject with a copy of the personal data undergoing processing. For any subsequent copies requested by the data subject, the Controller may charge a reasonable fee based on administrative costs. If the data subject requests a copy electronically, and unless the data subject indicates otherwise, the information shall be provided in a commonly used electronic format.
6. The User has the right to request that the Seller immediately rectify any inaccurate personal data concerning them. Taking into account the purposes of processing, the data subject has the right to request that incomplete personal data be completed, including by submitting an additional declaration.
7. The User has the right to demand that the Seller immediately delete his/her personal data, and the Seller is obliged without delay to do so. delete personal data without undue delay if one of the following applies:

the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;

the data subject objects to the processing and there are no overriding legitimate grounds processing;

the personal data have been processed unlawfully;

the personal data must be erased in order to comply with a legal obligation under Union or Member State law to which the controller is subject;
-
the personal data have been collected for in connection with the provision of information society services.
The above does not apply to the extent that processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation requiring processing under Union or Member State law to which the controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, for the establishment, exercise or defence of legal claims.
The user has the right to request that the controller restrict the processing of their personal data in the following cases:

when they contest the accuracy of the personal data - for a period enabling the controller to verify the accuracy of such data;

where processing is unlawful and the data subject opposes erasure of the personal data and requests the restriction of their use instead;

where the controller no longer needs the personal data for the purposes of processing, but the data subject requires them for the establishment, exercise, or defense of legal claims;

where the data subject has objected to processing - pending the verification whether the legitimate grounds of the controller override those of the data subject.

The Store uses so-called cookies. These files are saved on the User's computer or other end device by the Store server and provide statistical data about the User's activity in order to tailor the offer to their individual needs and tastes.

The User may disable cookies in their web browser at any time, although they should be aware that in some cases, disabling these files may impede the use of the Store's offerings. The use of non-essential cookies requires the User's prior consent, expressed via the cookie banner. The User may change or withdraw their consent at any time.

Cookies saved on the User's end device store information about:

4. When using the Store, the Google Analytics analytical tool and its separate cookies are also activated, which allow for the analysis of how Users use the Store.
5. Data collected by Google Analytics focuses primarily on the end device, browser, approximate location, and traffic within the Store, and does not directly concern a specific User.
6. Google Analytics is operated by Google LLC, an independent controller of personal data.
7. The Store uses Google Ads marketing tools operated by Google LLC, based in the USA, including remarketing and conversion tracking.
8. Google Ads tools enable the display of Store advertisements to people who have previously visited the Store website, based on saved cookies.
9. Data collected through Google Ads does not allow the Administrator to directly identify the User.
10. Data processing for marketing purposes using Google Ads takes place solely on the basis of the User's consent, expressed via the cookie banner.
11. Google LLC may process Users' personal data outside the European Economic Area. Przekazywanie danych odbywa się na podstawie standardowych klauzul umownych zatwierdzonych przez Komisję Europejską.

Sprzedawca zwraca uwagę, że jeżeli na stronie internetowej Sklepu zamieszczony jest link prowadzące do innych, nieadministrowanych przez Sprzedawcę stron internetowych, to nie odpowiada on ani za zawartość tych stron, ani za stopień ochrony prywatności realizowany przez administratorów tych stron. Podejmując decyzję o przejściu na takie strony, Użytkownik czyni to na własną odpowiedzialność. Zachęcamy przy okazji do zapoznania się z polityką prywatności realizowaną przez te strony, zanim Użytkownik udostępni im swoje dane osobowe.

Sprzedawca może wprowadzać zmiany do Polityki Prywatności, które będą obowiązywać po upływie 7 dni od ich opublikowania na stronie internetowej Sklepu.
